Connect Jessica Lal Murder case, Parliament Attack case,Priyadarshini Mattoo case...
Simple!!! These are some of the Never Ending cases of yesteryears :-)...All the above cases are to be appealed in Supreme court against the verdict advised by the high courts...
What's worth noting is that these are some of the notable cases that are brought to the limelight by the courtesy of the media...Wonder, how many cases like these never ending which are not covered by the media and whose convicts are moving freely just like the innocent people...This is very true in rural areas and villages and if the convict is in politically and financially sound position...
The Law enforcement in India is pathetic since we have lot of pending cases in all our courts, right from the sessions courts till Supreme court...Wonder!!! when all these pending cases or Never Ending cases will come to an end or if at all the convicted in these cases would be alive on the D-day of his trial for a crime committed in his teenage days...Absolute mockery of Indian Judiciary, Isn't it...Indeed, It happened in the Priyadarshini Mattoo case, where the convict got married and became a practising lawyer in Delhi itself leading a normal life just like any other Indian citizen for nearly 6 years...Is this what we call Justice?
Now why does it takes such a long time for courts to dissolve a case and drag on for a verdict...Really a debatable topic!!!
In my opinion, to start with, the Judicial system has in itself some flaws and loopholes...In olden days we had only one judge-The Kings who meted out justice to whatever cases/crimes that happened in his territory...Today our judicial system offers many hierarchy of justices starting from Subordinate courts, Sessions court, apex courts, High court till the apex of the judicial system - The Supreme Court...I believe that the primary reason for this was to hear more cases addressing larger junta and alleviate the burden on the Supreme court...But to me it seems to be the primary reason for the Delayed justice eventually adding up the case to the Neverending cases list...
Loopholes in this Judicial hierarchy, is that if a convict has been sentenced to death by the lower level courts (sessions or trial courts) he can appeal against the verdict in a higher level court (high court)...If he(convict) is not convinced on the justice, he has the option to file a petition against the verdict of High Court in the Supreme court...Appeals to the subsequent higher levels of judiciary are the loopholes that delays the justice eventually proving that its an absolute waste of time for the case to be dealt in the lower level courts...Jessica Lal murder case is a well known case wherein almost all of the main witnesses turned colours like a chameleon when the case was dealt in High court than trial courts...

Flaws of the Judicial system...Till the verdict of Parliament attack case, I was of the belief that the Supreme court's decision is final...But the decision of the President to delay the hanging of Mohammed Afzal considering a mercy petition and overuling the Supreme court verdict proved my belief wrong...If a Justice is delayed then it is worth to be treated as a Justice Denied in a case...
To me a country's judicial system is questionable when it couldn't resolve its own parliament attack case and track down the culprits and convict them for nearly 5 years...Oh blind Themis!! (Greek god of Justice) Wake up!!! Justice has to be meted out then and there whenever the balance of the Greek God is disturbed and those who disturb it has to be slaughtered with the iron sword...I call this as the "Modern Justice" and a solution to the NeverEnding cases... .
